WORK MAY PPU, .Lr p <br />uNjit_ !NSURanl~ : ~:xPIRE :~ A-2008-012-01 <br />' CLER OF COU( ~_,I . <br />~aTF AUG ~ 5 200$ <br />FIRST AMENDMENT TO UNITED INSPECTION <br />AND TESTING CONSULTANT AGREEMENT <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this ~ day of August 2008, by and between United Inspection & Testing, Inc., a <br />Delaware corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into Consultant Agreement A 2008-012 dated January 7, 2008, <br />(hereinafter "said Agreement") by which Consultant has provided material testing and <br />construction inspection services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the attached Fee Schedule to comply with California prevailing wage <br />requirements. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Amendment to Consultant Agreement, the parties agree as follows: <br />Section 2, COMPENSATION, shall be amended by replacing the current Appendix <br />C, with a new "Fee Schedule" dated .luly 1, 2008, attached hereto as Appendix C, and <br />incorporated by reference. <br />2.
