<br />Page 36 of 41 <br /> <br />2.04 PROTECTION OF EXISTING FACILITIES AND STRUCTURES <br /> <br />The Contractor shall exercise due care in protecting from damage all existing facilities, <br />structures, and utilities, both above surface and underground on the City's property. Any damage <br />to City, SAPRF, or private property caused by the Contractor's neglect shall be corrected and <br />paid for by the Contractor at no cost to the City of Santa Ana or SAPRF. The City of Santa Ana <br />and/or SAPRF shall make the determination of fault. The SAPRF representative reserves the <br />right to issue a Stop Work Notice if the Contractor does not promptly repair any damage, within <br />twenty-four (24) hours of the damage incurred. <br /> <br />If the SAPRF representative requests or directs the Contractor to perform work in a given area, it <br />will be the Contractor's responsibility to verify and locate any underground systems (i.e. utility <br />lines) and take responsibility for taking reasonable precaution when working in these areas. <br /> <br />PROTECTION OF EXISTING FACILITIES AND STRUCTURES - continued <br /> <br />Contractor shall call Underground Alert (800) 422-4133) at least two working days prior to <br />digging for line locations. Any damage or problems shall be reported immediately to the SAPRF <br />representative and the City of Santa Ana. If the Contractor discovers something unexpected or a <br />unique problem occurs, he should stop work and immediately contact an authorized SAPRF <br />representative for a timely resolution of the problem. <br /> <br />2.05 CONTRACTOR'S STAFF <br />The Contractor shall provide sufficient persoIlllel to perform all work in accordance with the <br />specifications set forth herein. A qualified, English speaking supervisor in the employ of the <br />Contractor shall supervise all of the Contractor's personnel. The supervisor shall be available at <br />all times to the SAPRF representative during work operations. The responsibility for all work <br />performed will remain with the full-time certified arborist. <br /> <br />The Contractor shall furnish the necessary competent and key personnel to properly supervise <br />and direct the work of fully equipped, competent and experienced crews as well as all safety <br />equipment, including but not limited to, all equipment and work procedures required by ANSI <br />Z 13 3.1-1994. The Contractor shall secure all timekeeping, bookkeeping and other necessary <br />clerical and office work required in the performance of the contract. <br /> <br />The Contractor shall be responsible for the superVision of all of his crews. He shall check all of <br />his crews regularly for proper quantity and quality of work, proper maintenance of tools and <br />equipment, and safety. <br /> <br />2.06 SUBSTITUTIONS <br />Whenever a specific type of material is specified, no substitutions shall be allowed without <br />written consent of the SAPRF representative. <br /> <br />2.07 CERTIFICATION OF MATERIALS <br />All materials shall be delivered on the site in original containers.
