IriSURANCE NOT ON FILE <br />WORK MAY NOT PROCEED <br />CLERK OF COUNCIL <br />DATE: g-~~-off <br />~ ~- Fv ~ Ca-~ THIRD AMENDMENT TO AGREEMENT <br />$,51 c,~atse~-, <br />THIS THIRD AMENDMENT TO AGREEMENT, is entered into on June 19, <br />2007, by and between RANCHO SANTIAGO COMMUNITY COLLEGE DISTRICT <br />("Consultant") and the CITY OF SANTA ANA, a charter city and municipal corporation <br />ofthe State of California ("City"). <br />Recitals: <br />A. The parties entered into Agreement # N-2004-101, dated July 27, 2004, (hereinafter <br />"said Agreement") by which Consultant has provided Wellness classes and physical <br />fitness analysis for Police and Fire employees. <br />N-2008-105 <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one-year period and increase compensation to <br />pay for services during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Third <br />Amendment to Agreement, the parties agree as follows: <br />1. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A-I attached hereto. The total sum to be <br />expended pursuant to this Agreement shall not exceed $6,500.00 during the 2007-OS <br />fiscal year." <br />2. Section 3, TERM, shall be amended to extend the termination date to June 30, 2008. <br />3. Except as herein amended al] terms and conditions of said Agreement shall remain in <br />full force and effect. <br />// <br />// <br />// <br />// <br />// <br />
