Zoning Ordinance Amendment No. 2008-02 <br />Conditional Use Permit No. 2008-23 <br />August 11, 2008 <br />Page 3 <br />of the project. Teak wood furnishings will also be provided in the <br />courtyard space. The landscape design incorporates trees, shrubs and <br />ground cover in multiple colors and in a layered effect to create a high <br />quality visual result. The proposed landscape design enhances the quality <br />of the project by framing and softening the appearance of the building, <br />providing shade and buffering it from the adjacent residences. <br />Analysis of the Issues <br />The applicant is proposing to develop an underutilized parcel of land <br />within the North Harbor Specific Plan. The North Harbor Specific Plan <br />encourages high quality development by focusing land uses into specific <br />commercial activity areas. The Specific Plan is divided into seven land <br />use activity areas to clearly reflect the intended character of the zone. <br />The subject parcel has two land use designations within the Specific Plan, <br />General Commercial and Single-Family Residence. The subject parcel is <br />approximately 600 feet deep, with the front 300 feet having a designation <br />of General Commercial and the rear 300 feet having a Single-Family <br />Residence designation. The proposed commercial development is allowed on <br />the front half of the site; however, it is not allowed in the rear portion <br />as it is zoned for residential use. <br />When taking into account that the site is one parcel and is not likely to <br />be developed with two separate and different uses at the front and rear <br />and residential would not be viable since it would be landlocked and have <br />no street frontage, it is recommended that the land use designation for <br />the rear of the site be changed to General Commercial (Exhibits 13 through <br />15) The change in the land use designation to general commercial will <br />allow the ability to create a consistent and well integrated development <br />project and enhance the character along Harbor Boulevard. As well, it <br />will provide the opportunity for development that supports uses to the <br />other focused project areas in the Harbor Specific Plan. <br />Additionally, a conditional use permit to allow restaurant uses is <br />required. Section 3.5.2 of the Specific Plan requires the approval of a <br />conditional use permit for restaurants and eating establishments. The <br />intent of the conditional use permit is to ensure that uses comply with <br />the goals and objectives of the North Harbor Specific Plan. The <br />proposed project includes 2,696 square feet of restaurant space on the <br />first floor of the building. The restaurant use will be consistent with <br />the Harbor Specific Plan and several policies of the General Plan. <br />75A-5 <br />
