N-2008-111 <br />. C ~-FY A~iDrne.~ <br />~kW~ C.O~ew.ci+~ <br />1. This serves as an agreement between the City of Santa Ana ("City) and Japan <br />Broadcasting Corporation-Nippon Hoso Kyokai ("Producer"), as of August z~. , 2008, in <br />connection with reporter Kenshi Fukuhaza's ("Reporter") documentary regazding the <br />City's efforts to combat graffiti. <br />2. The City hereby authorizes Reporter to film activities and personnel as permitted <br />by the Santa Ana Police Department on or off its premises for the creation of the <br />documentary. All of the Reporter's filming activity will be subject to and under the <br />control of the Department officer in chazge. <br />3. The rough cut of any footage to be used for the documentary (DVD or VHS) that <br />the Producer/Reporter intends to use shall be submitted to Deputy Chief Anthony <br />Levatino of the Santa Ana Police Department. Within ten days, City shall notify <br />Producer/Reporter in writing of any scenes which are to be excluded from the <br />documentary by listing such scenes on a form that identifies the date, officer, description <br />and time code of such scenes. Producer/Reporter shall exclude such scenes from the <br />documentary. <br />4. T'he use of any footage containing public figures shall require Producer/Reporter <br />to obtain appropriate clearances from such individuals. Ptoducer/Reporter shall also <br />obtain the appropriate appearance agreement and release of any and all participants in the <br />documentary. <br />5. Producer and Reporter agree to indemnify and hold harmless the City in <br />connection with any and all claims arising out of the actions of Producer's personnel, <br />agents, employees, contractors or authorized third parties in connecfion with the filming <br />and/or production of the documentary, including Producer's breach of this agreement. <br />6. Producer shall obtain all permits required by the City for filming in the City, <br />including but not limited to film permits, special event permits or licenses. <br />7. Producer will name the City as a "named additional insured" on its insurance <br />policy for 1 million dollars and will allow the City to examine the insurance policy to <br />verify such coverage. <br />8. Producer's personnel, agents, employees, contractors or authorized third parties <br />shall sign "Ride-A-Long" waivers if they will be in any Santa Ana Police Department <br />vehicles. <br />9. Producer represents the person executing this agreement have the authority to sign <br />and bind Producer's personnel, agents, employees, contractors or authorized third parties. <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE D(PIRES <br />
