Collectively, Valentin and the City may be referred to in this Agreement as <br /> "The Parties". <br /> RECITALS <br /> 1. On November 1, 2023, the Parties entered into a Cooperation Agreement (Agreement No. <br /> 2023-301)that provided an hourly reimbursable rate to Valentin for his agreement to <br /> cooperate,assist, participate and appear for various legal matters. The agreed upon rate <br /> under the terms of the Cooperation Agreement was$300 per hour. <br /> NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br /> terms and conditions of the Agreement, except as hereinafter modified, the Parties agree to the <br /> following: <br /> 1. Section 2, Compensation, shall be amended to increase the hourly rate paid to Valentin <br /> to $350.00 per hour, for a maximum of twenty(20) hours, strictly in relation to and solely <br /> for ONE CASE only. CASE as used herein shall mean the following pending civil <br /> litigation matter: Rita Ramirez v. City of Santcr zina, Orange County Superior Court Case <br /> No.: 30-2022-01287702-CU-OE-NJC. <br /> 2.
