<br />shall be in accordance with the written procedures referenced above in Section 403.2 and
<br />Exhibit J.
<br />403.6 Guarantee/Homeowner Protection Plan. Developer agrees to
<br />guarantee its work from defects for a period of at least one (1) year after construction is
<br />complete, with a five (5) year guarantee for the roof of each Unit. Developer shall
<br />provide each Homebuyer with all of the manufacturer's warranties and product
<br />information. Developer shall also provide the Homebuyers of each of the Affordable
<br />Units with a Homeowner Protection Plan.
<br />403.7 Subsequent Sales. The Grant Deed from Developer to any
<br />proposed qualified household shall restrict the use of the Property to owner-occupied, and
<br />shall restrict subsequent resales of the Property to Lower Income Households, at an
<br />Affordable Housing Cost, who agree to occupy the Unit(s) as their primary place of
<br />residence.
<br />404. Maintenance Covenants. The Developer shall maintain the Sites and all
<br />improvements thereon, including all landscaping, in compliance with the terms of the
<br />Redevelopment Implementation Plan and with all applicable provisions of the City of
<br />Santa Ana Municipal Code up until sale and move-in of the homebuyers.
<br />405. Nondiscrimination Covenants. The Developer covenants by and for
<br />itself and any successors in interest that there shall be no discrimination against or
<br />segregation of any person or group of persons on account of race, color, creed, religion,
<br />sex, marital status, national origin or ancestry in the construction, sale, transfer, use,
<br />occupancy, tenure or enjoyment of the Sites, nor shall the Developer itself or any person
<br />claiming under or through it establish or permit any such practice or practices of
<br />discrimination or segregation with reference to the selection, location, number, use or
<br />occupancy of Sites. The foregoing covenants shall run with the land.
<br />Developer shall refrain from restricting the sale of the Sites on the basis of race,
<br />color, religion, sex, martial status, disability, ancestry or national origin of any person.
<br />All such deeds, shall contain or be subject to substantially the following
<br />nondiscrimination or nonsegregation clauses:
<br />a. In deeds: "the grantee herein covenants by and for himself or
<br />herself, his or her heirs, executors, administrators and assigns, and all persons claiming
<br />under or through them, that there shall be no discrimination against or segregation of, any
<br />person or group of persons on account of race, color, creed, religion, sex, marital status,
<br />national origin or ancestry in the sale, lease, sublease, transfer, use occupancy, tenure or
<br />enjoyment of the land herein conveyed, nor shall the grantee or any person claiming
<br />under or through him or her, establish or permit any such practice or practices of
<br />discrimination or segregation with reference to the selection, location, number, use or
<br />occupancy of tenants, lessees, subtenants, sublessees or vendees in the land herein
<br />conveyed. The foregoing covenants shall run with the land."
