General Procedures for Handling Non -Criminal Violations of the Act <br />The following procedure is promulgated to meet the requirements ements f Title 20,s f and the Code n <br />of <br />Federal Regulations, Section 667.600 through667.640 regulations, <br />the State and <br />Sec <br />181(c) of the Act (Public Law 105.200: 29 U.S. Code Sec. 2931 et seq.) <br />LWIA level for the receipt, investigation, hearing, d resolution o complassistance,aints babor unions, <br />y WIA <br />participants, subrecipients, applicants for participation, o <br />community based organizations, or any other persons. <br />These procedures provide for resolution of non -criminal complaints arising from the <br />operation of the Santa Ana LWIA. <br />A complaint is defined here as a written expression by apes, party alleging a violation <br />otherof e <br />Act, regulations promulgated under the Act, recipient9 <br />specific agreements under the Act, including terms and codconditionsof empoyment of such <br />participants in employment training programs. All complaints, <br />s and <br />withdrawals shall be in writing. These procedures <br />connection are intended <br />to with W�A programs operated <br />lve matters which <br />concern policies, procedures or action(s) arising <br />by each LWIA grant recipient and subrecipient under the Act. <br />These procedures shall not be construed as affecting <br />any <br />lale abd copditio seof <br />dy <br />outside of the WIA complaint process (i.e., disputes regarding terms <br />employment of any employee who is not a participant), either separately or simultaneously, <br />that a person may wish to pursue in the resolution of a non-WIA complaint.
