REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />NOVEMBER 17, 2008 <br />TITLE: <br />VARIANCE NO. 2008-18 TO ALLOW A <br />REDUCTION IN LANDSCAPED SETBACKS AND <br />VARIANCE NO. 2008-19 TO ALLOW A <br />SERVICE STATION BUILDING TO EXCEED THE <br />HEIGHT STANDARDS AT 3414 SOUTH MAIN <br />STREET - FIED~R GROUP, APPLICANT <br />2 ~ (' ~~-- <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 15' Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Variance No. 2008-18 as <br />conditioned and Variance No. 2008-19 as conditioned. <br />PLANNING COMMISSION ACTION <br />On October 13, 2008, the Planning Commission adopted a resolution <br />approving Variance No. 2008-18 as conditioned to allow a reduction in <br />landscaped setbacks and Variance No. 2008-19 as conditioned to allow a <br />building that exceeds the height standards by a vote of 5:0 (Gartner and <br />Yrarrazaval absent) for a new service station at 3414 South Main Street <br />in the Arterial Commercial (C5) zoning district. The Planning Commission <br />added a condition that requires staff, the applicant, and the property <br />owner for the adjacent apartment complex to meet and develop a landscape <br />solution for screening the north and west sides of the new building <br />(Exhibit A). <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />J M.
