LEASE <br />T] IIS LFASF (Lease) is made 2009 ("Effective Bate"), by and between <br />O ZANG1 (,'()I 'NT),` T=l.OOD C:.C)N"I`ROL DIS`I'RW l', a body corporate and politic. hereinafter referrers <br />to as "DIS,rRIC:"T," and the C'1TY OF SANTA ANA. a municipal corporation. hereinafter referred to as <br />"i NAN T," without regard to number and gender. <br />I. DEFINITIONS (PMA2.I S) <br />The following words in this Lease hav; the significance attached to them in this clause, unless otherwise <br />apparent from context: <br />"Board of Supervisors" means the Board of Supervisors of the County of Orange acting as the governing <br />board cif the Orange County Flood Control District. <br />"County" means the County of Orange. a political subdivision of the `Mate of Califo nia <br />"Director" nuc ans the Director. 0(.' Public Works. County ol'Oran.:e. or designee. <br />"Flood Control Channel" means the Santa Anti River Channel and appurtenant structures located <br />adjacent to the easterly border of the Icasehold premises. <br />2. LIMIT' TION OF THE LEASEHOLD (PMA5.I S) <br />This Lease and the rights and privileges granted 'I T'NANT in and to the Premises are subject to all <br />covenants, conditions. restrictions, and exceptions of record, or apparent. Nothing contained in this l..,ease <br />or in any document. related hereto shall be construed to imply the conveyance to `IT:NA `I° of rights in the <br />Premises which exceed those owned by DIS'I"TZWT, or any representation or warranty. either express o= <br />implied, relating to the nature or condition ofthe Premises or DIS'IkIZK-FS interest therein.
