F;"a wce- ( 30 THIS FIRST <br />FIRST AMENDMENT TO AGREEMENT <br />AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />maw ?,re,,AOK'6n9the 5`h day of November, 2008, by and between Bartel Associates, LLC <br />("Consultant") and the City of Santa Ana ("City"). <br />Recitals: <br />A. The parties entered into Consultant Agreement A-2008-047, dated February 4, 2008, <br />(hereinafter "said Agreement") by which Consultant has provided actuarial consulting <br />services to the City. <br />B. Due to a delay in obtaining information necessary to complete the actuarial study, and <br />at the request of the City, Consultant has continued to provide services related to said <br />Agreement. <br />C. The parties wish to amend the Term of said Agreement to allow for completion of the <br />services and delivery of the finished study. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on February 4, 2008 and continue until Consultant <br />delivers, and City accepts, the final Actuarial Study of Retiree Healthcare Costs, <br />unless terminated earlier in accordance with Section 12, below." <br />2. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
