REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />DECEMBER 1, 2008 <br />TITLE: <br />AGREEMENT AMENDMENT TO GROUND <br />LEASE WITH DELHI CENTER <br />(~ <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 1S` Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute the <br />attached agreement amendment to the ground lease with Delhi Center, <br />subject to non-substantive changes approved by the City Manager and City <br />Attorney. <br />DISCUSSION <br />On September 5, 2000, the City of Santa Ana entered into a 20-year ground <br />lease agreement with Delhi Center, a California non-profit corporation, to <br />permit the construction of a community center and ancillary parking areas <br />at Delhi Park located at 2314 South Halladay Street. <br />Delhi Center is planning to implement a California head start educational <br />facility within the existing community center to serve the needs of the <br />surrounding community. This proposed use is in compliance with the <br />permitted uses specified in the original lease agreement. The State <br />requires that a playground be installed on the premises for the head start <br />program participants. To comply with this requirement, Delhi is <br />requesting an expansion to the original leased area, which will require <br />the removal of the west parking lot in order to accommodate the fenced <br />playground area.
