The proposed project, as conditioned, conforms to all <br />provisions of the zoning code, including landscaping, <br />setbacks, parking, lot size and street frontage. No variances <br />are required for this project. Existing infrastructure in the <br />area is adequate to service the project. Covenants, <br />Conditions and Restrictions (CC&Rs) are required for the <br />project and needs to be approved by the City prior to City <br />Council approval of the final map. <br />3. The project site is physically suitable for the type and density of the <br />proposed project. <br />The proposed site is physically suitable for the medical office <br />and commercial building that has been constructed as <br />subdivisions for condominium purposes do not affect the <br />conformance of the building or the site. The 57,000 square <br />foot building results in a floor area ratio (FAR) of .34 which is <br />below the maximum (FAR) for the General Commercial (GC) <br />General Plan land use designation. Additionally, the building <br />is located on a previously developed site already containing <br />other commercial and office buildings. <br />4. The design and improvements of the proposed project will not <br />cause substantial environmental damage or substantially and <br />avoidable injure fish or wildlife of their habitat. <br />The project site is located in an urbanized area, with no <br />known fish or wildlife populations existing on the project site. <br />Therefore, the proposed subdivision will not cause any <br />substantial environmental damage or substantially and <br />avoidably injure fish and wildlife or their habitat. <br />5. The design or improvements of the proposed project will not cause <br />serious public health problems. <br />The proposed subdivision will not have any detrimental <br />effects upon the general public. The project will incorporate <br />sewer, water and other necessary infrastructure <br />improvements as conditioned in Development Project <br />Review No. 2008-66. <br />6. The design or improvements of the proposed project will not cause <br />conflict with easements acquired by the public at large for access <br />through or use of property within the proposed project. <br />Resolution No. 2009-03 <br />3 2A-11 Page 2 of 6 <br />
