KO- 1 /26/09 <br />RESOLUTION NO. 2009- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING AND ADOPTING THE NEGATIVE <br />DECLARATION (ENVIRONMENTAL REVIEW NO. 2004-136) <br />AND ADOPTING AIRPORT ENVIRONS ELEMENT AND <br />AMENDING THE LAND USE AND NOISE ELEMENTS OF <br />THE GENERAL PLAN OF THE CITY OF SANTA ANA <br />(GPA NO. 2004-03) <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. The Public Utilities Code Section 21675 requires Airport Land Use <br />Commissions to formulate a comprehensive land use plan for the area <br />surrounding each public airport. On November 15, 2007, the Orange <br />County Airport Land Use Commission updated its Airport Environs Land <br />Use Plan (AELUP). <br />B. California Government Code Section 65302.3 requires local agencies to <br />amend their general plans, as necessary, when the Airport Land Use <br />Commission amends its AELUP. <br />C. On October 13, 2008, the Planning Commission recommended that the City <br />Council approve and adopt the Negative Declaration, Environmental Review <br />No. 2004-136 and adopt a resolution approving General Plan Amendment <br />No 2004-03 to adopt the City of Santa Ana's Airport Environs Element and <br />to amend the City's Land Use and Noise Elements of the General Plan by a <br />vote of 5:0 (Gartner and Yrarrazaval absent). <br />D. The Airport Land Use Commission of Orange County held a public hearing <br />on December 18, 2008, and found the City of Santa Ana's Airport Environs <br />Element consistent with the John Wayne Airport Environs Land Use Plan. <br />E. On February 2, 2009, the City Council of the City of Santa Ana held a duly <br />noticed public hearing and at that time considered all testimony, written <br />and oral. <br />Resolution No. 2009-XXX <br />Page 1 of 4 <br />75C-64 <br />
