<br />LssO 1122/09 <br /> <br />RESOLUTION NO. 2009-007 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING THE APPLICATION FOR <br />GRANT FUNDS UNDER THE ENVIRONMENTAL <br />ENHANCEMENT AND MITIGATION PROGRAM FOR <br />URBAN NEIGHBORHOOD FOREST PLANTING <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. The Legislature of the State of California has enacted California Streets <br />and Highways Code 9164.56, which is intended to provide $10 million <br />annually for grant funds to local, state and federal agencies and nonprofit <br />entities for projects to enhance and mitigate the environmental impacts of <br />modified or new public transportation facilities; and <br /> <br />B. The Resources Agency has established the procedures and criteria for <br />reviewing grant proposals and is required to submit to the California <br />Transportation Commission a list of recommended projects from which the <br />grant recipients will be selected; and <br /> <br />C. The procedures and criteria established by the Resources Agency require <br />a resolution certifying City Council approval of submission of the <br />application to the State; and <br /> <br />D. The City will comply with the assurances set forth in the application; and <br /> <br />E. If selected, the City of Santa Ana will enter into an agreement with the <br />State of California to carry out the environmental enhancement and <br />mitigation project. - Urban Neighborhood Forest Planting. <br /> <br />Section 2. The City Council hereby approves the filing of an application for the <br />Environmental Enhancement and Mitigation Program in the amount of $116,000 to fund <br />the urban neighborhood forest planting project. <br /> <br />Section 3. The City Council certifies that the City of Santa Ana will make <br />adequate provisions for the operation and maintenance of the project. <br /> <br />Section 4. The City Council appoints the City Manager or the Executive <br />Director of the Public Works Agency, or their designee(s), as agent of the City of Santa <br />Ana to conduct all negotiations, execute and submit all documents, including but not <br />limited to applications, agreements, amendments, payment requests and so on, which <br />may be necessary for the completion of the project. <br /> <br />Resolution No. 2009-007 <br />Page 1 of 2 <br />
