INSURANCE ON FILE N-2007-078-02 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />1,OI-C) <br />CLERK OF COUNCIL <br />DATE- 1-30-01 SECOND AMENDMENT TO AGREEMENT <br />r,t, THIS SECOND AMENDMENT TO AGREEMENT is entered into on January <br />15, 2009, by and between National Econ Corporation, a California corporation <br />("Consultant') and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ("City"). <br />RECITALS: <br />A. The parties entered into Agreement #N-2007-078, dated July 5, 2007, (hereinafter <br />"said Agreement") by which Consultant has provided environmental remediation <br />services and hazardous materials testing. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />add compensation to provide for the uninterrupted provision of services. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Second Amendment to Agreement, the parties agree as follows: <br />1. Section 2.a COMPENSATION, shall be amended to increase compensation by <br />$25,000.00 to pay for services provided from July 1, 2008 through June 30, 2009. <br />2. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />WITNESS WHEREOF, the parties hereto have executed this Second Amendment to <br />Agreement on the date and year first written above. <br />ATTEST: <br />PATRICIA E.
