1-.;:;.;J~~r.~~G: i;~l REQUIRED <br />Y~3'iK MAY PROCEED <br />CLEkK OF COUNCIL <br />DATE: 1- ~c a~1 <br />C~~d~ ~OmP-Z <br />FIRST AMENDMENT TO <br />LEASE AGREEMENT BETWEEN <br />THE CITY OF SANTA ANA AND <br />CLARA CASTANEDA <br />N-2007-091-01 <br />THIS FIRST AMENDMENT, made and entered into this 1" day of January, 2009, by <br />and between the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California (hereinafter "Landlord") and <br />Clara Castaneda (hereinafter "Tenant"). <br />RECITALS <br />A. The Landlord and Tenant entered into that certain Lease Agreement ("Agreement") <br />dated September 1, 2007 (N-2007-091), for Tenant to lease the property located at 921 N. Bristol <br />Street, Santa Ana, CA (APN #405-262-26). <br />B. The parties thereto now desire to extend the term and add a provision to said <br />Agreement. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as <br />hereby amended, the parties hereto do hereby agree as follows: <br />1. The "Term of Lease" section of said Agreement (Section 3) is hereby <br />amended and extended through December 31, 2009. <br />2. The "General Provisions" section of said Agreement (Section 14) is hereby <br />amended to include the following provision: <br />"Tenancy is considered a post acquisition agreement between Landlord and Tenant, thus <br />Tenant is not entitled to any relocation benefits upon termination of this Lease <br />Agreement." <br />Except as hereinabove modified, the terms and conditions of said Agreement, remain <br />unchanged and in full force and effect. <br />
