REQUEST <br />COUNCIL <br />FOR <br />ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 2, 2009 <br />TITLE: <br />AGREEMENT WITH TELECOM PARTNERS <br />GROUP CORP, dba AT5 <br />COMMUNICATIONS FOR WIRELESS <br />COMMUNICATION CONSULTING <br />SERVICES <br />CIT M AGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 151 Reading <br />^ Ordinance on 2nd Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute the <br />attached Amended and Restated Agreement with ATS Communications to <br />provide wireless communication consulting services for a two-year term <br />on a commission basis, subject to non-substantive changes approved by <br />the City Manager and City Attorney. <br />DISCUSSION <br />In January 2006 the City entered into a three-year agreement with ATS <br />Communications to provide wireless communication consulting services on <br />a commission basis. Pursuant to the agreement, which expired on <br />December 31, 2008, ATS developed a wireless facilities master plan in an <br />effort to maximize wireless communications while minimizing the number <br />of wireless facilities. In addition, ATS has served as the City's agent <br />in effectively coordinating the placement of new facilities on City- <br />owned properties, and has worked with City staff and wireless carriers <br />to facilitate co-location of multiple transmitters on single towers <br />wherever possible. <br />With the completion of the wireless master plan, ATS has marketed potential <br />sites to the five wireless service providers in the Santa Ana market. Over <br />the last three years, ATS has worked on 19 potential sites. Of those, <br />lease agreements for six sites have been completed or are close to <br />completion, and several remain in process. In addition, ATS has worked <br />with the City to develop a master lease agreement in an effort to <br />streamline and simplify the negotiations process. <br />Under the agreement, ATS will continue its exclusive right to market <br />City-owned land for lease to wireless service providers for the next two <br />years, with the same terms and conditions of the original agreement. <br />ATS will continue to maintain the City's wireless facilities master <br />plan, and assist staff in managing all wireless facility leases, <br />including design, installation and ongoing management. <br />25A-1 <br />
