EIR No. 2007-02; ZOA No. 2008-04; <br />DA No. 2004-04; CUP No. 2008-34; <br />VTTM No. 2008-04; and SPR No. 2008-05 <br />January 12, 2009 <br />Page 7 <br />In their decision to amend SD-59 in 2004, the City Council directed the <br />developer to investigate the feasibility of constructing a residential <br />tower on a two acre parcel in the northeast portion of the site. After <br />careful consideration, the developer concluded that a high-rise <br />residential condominium project was feasible and appropriate, and <br />submitted plans for review. As a result of the proposed project, the <br />development of this parcel differs from the actions previously approved <br />and therefore requires an amendment to the current SD-59 (Exhibit 5). <br />The following highlights those changes: <br />Land uses <br />The primary change to SD-59 is to allow a residential tower by issuance <br />of a conditional use permit. In 2004, in order to ensure the Council's <br />opportunity to review a project on the remaining two acre parcel, SD-59 <br />was amended to only allow one single-family residence per acre. By <br />doing so, future development of the site beyond two single-family homes <br />would allow the Council to provide future input and review. <br />Additionally, staff is requesting changes that help to clarify the uses <br />permitted on the commercial component. These changes would not add nor <br />delete uses currently allowed within SD-59. The changes would merely <br />provide clearer direction on the list of uses currently permitted. A <br />variety of commercial uses will continue to be permitted with an <br />emphasis on sit-down eating establishments and retail. <br />Parking <br />The current SD-59 standards do not address parking requirements for <br />residential condominium units configured in a high rise. Unlike the <br />current development on-site, the high rise will not provide two-car <br />garages for each unit but rather provide parking within a parking <br />structure design. The proposed parking garage is designed with two <br />levels of parking below grade and four levels above grade. A total of <br />729 parking spaces will be provided including visitor parking. The <br />parking accommodates two parking spaces per unit, with studio units <br />assigned one parking space each and an additional 70 parking spaces for <br />visitors. An amendment to SD-59 is needed to include these parking <br />standards for Lot 1 of Vesting Tentative Tract Map No. 17242. <br />75A-9 <br />
