Approve and adopt the Negative Declaration, Environmental Review No. <br />2008-98. <br />2. Adopt an ordinance approving Zoning Ordinance Amendment No. 2008-01. <br />3. Adopt an ordinance approving Ordinance Amendment No. 2008-02. <br />DISCUSSION <br />Background <br />On May 21, 2007 the City adopted a 45-day moratorium to prohibit the <br />establishment or expansion of any existing massage parlor or issuance of <br />new (non-replacement) massage technician permits. This moratorium was <br />extended for an additional 22 months and 15 days to allow the Planning <br />Division and Police Department adequate time to create development <br />standards regulating this new use. The need for further regulation was <br />the result of a dramatic increase in massage establishment requests <br />following a March 2007 raid by the Orange County District Attorney and <br />several police departments of 10 facilities (massage parlors or <br />acupuncture clinics) in Anaheim, Orange, Tustin and Dana Point as being <br />alleged fronts for prostitution. <br />Chapter 41 of the Santa Ana Municipal Code does not specifically <br />identify massage parlors as a land use or designate zoning districts <br />throughout the City where massage parlors may be permitted. As such, <br />these provisions of the Municipal Code need review, study and ultimately <br />EXHIBIT A <br />75C-2 <br />
