(e) No massage, for a fee, shall be done at the residence of a permitted massage technician or in any <br />hotel, or motel in the City. <br />(fl It is a violation of this chapter for a permit holder to commit and the City may deny an <br />application for a permit or discipline a permit holder for, any of the following <br />>~ Unprofessional conduct, including, but not limited to, denial of licensure, revocation. suspension <br />restriction, or any other disciplinary action against a certificate holder by another state or <br />territory of the United States, by any other government agency or by another California health <br />care professional licensing board. A certified copy of the decision order or judgment shall be <br />conclusive evidence of these actions. <br />(2) Procuring a permit by fraud, misrepresentation, or mistake. <br />(3) Violating or attempting to violate, directly or indirectly or assisting in or abetting the violation <br />of, or conspiring to violate, any provision or term of this chapter or any rule or bylaw adopted by <br />the City. <br />(4) Conviction or plea of uilty or polo contendere to any felony or misdemeanor or infraction that is <br />substantially related to the qualifications or duties of a permit holder in which event the record <br />of the conviction or plea shall be conclusive evidence of the crime. <br />(5) Conviction or plea of guilty or polo contendere to an f~lony or misdemeanor or infraction <br />directly related to the operation of a massage establishment. <br />~6) Impersonating an applicant or actin as a proxy for an applicant in any examination referred to <br />under this chapter for the issuance of a permit. <br />~) Impersonating a certified practitioner or therapist or permitting or allowing an uncertified person <br />to use a permit• <br />(8) Committing any fraudulent, dishonest or corrupt act that is substantially related to the <br />qualifications or duties of a permit holder. <br />(9) Committing any act punishable as a sexually related crime. <br />Sec. 22-13. Suspension or revocation. <br />When the city manager finds that any person holding a permit under the provisions of Chapter 22 has <br />violated the provisions of this chapter or is found guilty of conduct which would form the basis of denial of the <br />license as set forth in sections 22-2 and 22-4, he may revoke or suspend the permit. No such revocation shall <br />become effective until the permit holder has been notified in writing by certified mail of his right to appeal the <br />revocation decision pursuant to the provisions or Chapter 3 of this Code.
