Section 10. Section 22-6 of the Santa Ana Municipal Code is hereby amended to <br />add and revise exemptions to the chapter, such that it reads as follows (new language in <br />bold, deleted language in strikeout for tracking purposes only): <br />Sec. 22-6. Exemptions. <br />The provisions of this chapter shall not apply to the following classes of <br />individuals while engaged in the performance of the duties of their respective <br />professions: <br />(a) Acupuncturists, Physicians, surgeons, chiropractors, osteopaths, <br />or physical therapists who are duly licensed to practice their <br />respective professions in the State of California. Practical nurses, <br />licensed vocational nurses, or other persons without <br />qualifications as massage technicians and without first <br />obtaining a massage technician permit pursuant to this <br />chapter, whether employed or contracted by acupuncturists, <br />physicians, surgeons, chiropractors or osteopaths or not, may <br />not give massage or massage procedures. <br />(b) Hospitals, nursing homes, sanatoriums, or other health care <br />facilities duly licensed by the State of California. <br />(c) Nurses registered under the laws of the State of California. <br />(d) Barbers, <br />cosmetologists, manicurists and estheticians who are duly <br />licensed under the laws of the State of California when engaged in <br />such practice within the scope of their license. Except that this <br />exception applies solely for the massaging of the neck, face <br />and/or scalp of the customer of said barber or cosmetologist <br />or in the case of a licensed manicurist, the massaging of the <br />forearm, hands, calves and/or feet. State licensed estheticians <br />may provide skin care, which is limited to the face, neck, arms <br />or upper part of the human body. <br />(e) Accredited high schools and colleges, and coaches and trainers <br />therein while acting within the scope of their employment. <br />(f) Trainers of any amateur, semiprofessional or professional athlete or <br />athletic team. <br />(g) An individual who is certified pursuant to Chapter 10.5, <br />commencing with Section 4600, of Division 2 of the California <br />Business and Professions Code, and who is practicing <br />consistent with the qualifications established by his or her <br />Ordinance No. NS-XXX <br />Page 14 of 36 <br />11A-14 <br />
