<br />bk:3/9/09 <br /> <br />and adopted this Resolution, and each and all provisions hereof, irrespective of the fact <br />that one or more provisions may be declared invalid. <br /> <br />Section 6: This Resolution shall take effect immediately upon its adoption by <br />the City Council, and the Clerk of the Council shall attest to and certify the vote adopting <br />this Resolution, except that, as required by Government Code ~ 66017(a), the fee <br />modifications set forth herein shall not take effect for sixty (60) days after adoption of <br />this Resolution. <br /> <br />Section 7: <br /> <br />A. The following "pipeline projects" (as defined in Section 7.C., below) shall <br />not pay the fees established by this Resolution, but rather shall be subject to the fees <br />set forth in Resolution No. 2008-041, unless the fee established by this Resolution is <br />lower than the fee set forth in Resolution No. 2008-041, in which case the lower fee <br />shall be paid by these "pipeline projects." : <br /> <br />1. development agreement, <br /> <br />2. tentative tract map, <br /> <br />3. tentative parcel map, <br /> <br />4. conditional use permit, <br /> <br />5. variance, <br /> <br />6. minor exception, <br /> <br />7. grading permit, or <br /> <br />8. building permit (including "foundation only" building permit). <br /> <br />B. The fees to be paid by a "pipeline project" shall increase annually, <br />commencing July 1, 2009, from those fees set forth in Resolution No. 2008-041 by the <br />increase in the Consumer Price Index-All Urban Consumers for the Los Angeles- <br />Riverside-Orange County area, published by the United States Bureau of Labor <br />Statistics (or substitute index chosen by the Executive Director of Planning and Building <br />Agency should this index be discontinued), hereafter referred to as "CPI increase." <br />However, if a fee established for non-"pipeline projects" is less than the "pipeline <br />project's" CPI increased fee pursuant to this subsection, then only the lower fee shall be <br />assessed and collected. To the extent this subsection is contrary to the provisions of <br />state law or a valid development agreement adopted by this Council, this subsection <br />shall not apply. <br /> <br />Resolution No. 2009-018 <br />Page 3 of 38 <br />
