<br />ROH 3/2/09 <br /> <br />(e) The city manager, after receiving the application and aforementioned <br />recommendation, shall grant the permit if he finds in accordance with <br />section 22-3(f)(1) through 22-3(f)(6), and in addition finds: <br /> <br />(1) The applicant has furnished an acceptable medical certificate in <br />compliance with this chapter. <br /> <br />(2) The applicant has furnished an acceptable diploma or certificate of <br />graduation from a "recognized school", or is an active member in <br />good standing in the American Massage and Therapy Association <br />(AMTA). <br /> <br />(3) Proof of certification of passage of the required City of Santa Ana <br />test. <br /> <br />(4) The applicant must provide a valid and current CPR certificate <br />issued by the American Red Cross or the American Heart <br />Association. <br /> <br />(5) The applicant has not had a massage establishment permit or a <br />massage technician's permit or other similar license or permit <br />denied or revoked for cause by this city or any other city located in <br />or out of this state within ten (10) years prior to the date of <br />application. <br /> <br />(6) The applicant is at least eighteen (18) years of age. <br /> <br />(f) Any person denied a permit by the city manager pursuant to these <br />provisions may appeal to the city council pursuant to Chapter 3 of the <br />Santa Ana Municipal Code. <br /> <br />(g) It shall be the responsibility of any permit holder to notify the City of his or <br />her home address, as well as the address of any business establishment <br />where he or she regularly works as a massage technician, whether as an <br />employee or as an independent contractor. A permit holder shall notify <br />the City within thirty (30) days of changing either his or her home address <br />or the address of the massage establishment where he or she regularly <br />works as a massage technician. <br /> <br />Section 9. Section 22-5.1 is added to Chapter 22 of the Santa Ana Municipal <br />Code to read in full as follows: <br /> <br />Sec. 22-5.1. Massage technician permit- renewal. <br /> <br />(a) Applications for the renewal of a permit shall be filed with the Chief of <br />Police at least sixty (60) calendar days before the expiration of the current <br />permit.
