<br />ROH 3/2/09 <br /> <br />Sec. 22-6. Exemptions. <br /> <br />The provisions of this chapter shall not apply to the following classes of <br />individuals while engaged in the performance of the duties of their respective <br />professions: <br /> <br />(a) Acupuncturists, physicians, surgeons, chiropractors, osteopaths, or <br />physical therapists who are duly licensed to practice their respective <br />professions in the State of California. Practical nurses, licensed <br />vocational nurses, or other persons without qualifications as massage <br />technicians and without first obtaining a massage technician permit <br />pursuant to this chapter, whether employed or contracted by <br />acupuncturists, physicians, surgeons, chiropractors or osteopaths or not, <br />may not give massage or massage procedures. <br /> <br />(b) Hospitals, nursing homes, sanatoriums, or other health care facilities duly <br />licensed by the State of California. <br /> <br />(c) Nurses registered under the laws of the State of California. <br /> <br />(d) Barbers, cosmetologists, manicurists and estheticians who are duly <br />licensed under the laws of the State of California when engaged in such <br />practice within the scope of their license. Except that this exception <br />applies solely for the massaging of the neck, face and/or scalp of the <br />customer of said barber or cosmetologist or in the case of a licensed <br />manicurist, the massaging of the forearm, hands, calves and/or feet. <br />State licensed estheticians may provide skin care, which is limited to the <br />face, neck, arms or upper part of the human body. <br /> <br />(e) Accredited high schools and colleges, and coaches and trainers therein <br />while acting within the scope of their employment. <br /> <br />(f) Trainers of any amateur, semiprofessional or professional athlete or <br />athletic team. <br /> <br />(g) An individual who is certified pursuant to Chapter 10.5, commencing with <br />Section 4600, of Division 2 of the California Business and Professions <br />Code, and who is practicing consistent with the qualifications established <br />by his or her certification. <br /> <br />Section 11. Section 22-6.1 is added to Chapter 22 of the Santa Ana Municipal <br />Code to read in full as follows: <br /> <br />Sec. 22-6.1. Persons working for exempted individuals. <br /> <br />Any person conducting massage for an exempted class individual must possess <br />a massage technician permit and shall comply with all massage regulations.
