CDAC~-~ <br />S: Sav, C~orc>Qe- <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on December 12, 2008, <br />by and between Platinum Pool & Spa, a sole proprietorship ("Consultant") and the City of Santa <br />Ana, a charter city and municipal corporation organized and existing under the Constitution and <br />laws of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into that certain Agreement N-2008-095, dated July 1, 2008, (hereinafter <br />"said Agreement") by which Consultant has provided fountain maintenance and repair <br />services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the <br />Scope of Services and increase compensation to pay for the additional services provided. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except [hose amended in this First Amendment to <br />Agreement, the parties agree as follows: <br />1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the <br />following: <br />"Consultant shall perform maintenance and repair services for the fountain(s) at the Santa <br />Ana Regional Transportation Center and the 2"" Street Mall, as set forth in Exhibit A to said <br />Agreement. Consultant may provide additional repair services for the described fountains. <br />upon the written approval of the Deputy City Manager for Development Services. The <br />parties agree that such additional services shall include Consultant's repair of the <br />recirculation pump for the fountain at the 2"d Street Mall, at a cost of $489." <br />2. Section 2, COMPENSATION, shall be amended to increase compensation by $2,000, to pay <br />for the additional services, as set forth in Section 1, above. The total amount available for <br />services pursuant to said Agreement shall not exceed $7,000.00 during the term of said <br />Agreement. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />/I <br /> <br />
