Adopt a resolution approving Variance No. 2009-01 as conditioned. <br />DISCUSSION <br />Request of Applicant <br />Coast to Coast Commercial, LLC, on behalf of Sonic Restaurant, is <br />requesting approval of Conditional Use Permit Nos. 2009-03 and 2009-04 <br />and Variance No. 2009-O1 to allow a new Sonic Restaurant with drive- <br />through service, to operate between 12:00 a.m. and 5:00 a.m. and to <br />reduce the side yard landscaped setback at 3531 South Fairview Street. <br />Property Description <br />The subject site is a 0.51 acre parcel <br />corner of Fairview Street and MacArthur <br />use designation for the site is General <br />within the Arterial Commercial (C-5) <br />currently developed with a 2,200 squa~ <br />drive-through service.
