k. Public Contracts Code Recipient will comply, and all its contractors (or subrecipients) <br />will comply, with all requirements of the California Public Contract Code Section 10295.3, as <br />applicable. <br />1. Copeland "Anti -Kickback" Act — Recipient will comply, and all its contractors (or <br />subrecipients) will comply, with all requirements of the Copeland "Anti -Kickback" Act (40 U.S.C. <br />3145) as supplemented in Department of Labor regulations (29 CFR Part 3), as applicable. <br />in. David -Bacon Act — Recipient will comply, and all its contractors (or subrecipients) will <br />comply, with all requirements of the Davis -Bacon Act (40 U.S.C. 3141-3144 and 3146-3148) as <br />supplemented by Department of Labor regulations (29 CFR Part 5), as applicable. <br />n. Clean Air Act — <br />1. The contractor agrees to comply with all applicable standards, orders or regulations <br />issued pursuant to the Clean Air Act, as amended, 42 U.S.C. § 7401 et seq. <br />2. The contractor agrees to report each violation to CITY and understands and agrees <br />that the CITY will, in turn, report each violation as required to assure notification to the <br />Federal Emergency Management Agency, and the appropriate Environmental Protection <br />Agency Regional Office. <br />3. The contractor agrees to include these requirements in each subcontract exceeding <br />$150,000 financed in whole or in part with Federal assistance provided by FEMA. <br />P. Energy and Conservation — Recipient will comply, and all its contractors (or subrecipients) <br />will comply, with all requirements of the Energy Policy and Conservation Act (42 U.S.C. 6201), <br />as applicable. <br />q.
