MEMORANDUM <br />To: <br />From: <br />Subject: <br />Assistant City Manager <br />Executive Director/ <br />Plamung & Building Agency <br />Date: April 14, 2009 <br />CONDITIONAL USE PERMIT NO. 2009-06 FOR AN ALCOHOL BEVERAGE <br />CONTROL LICENSE LOCATED AT 3600 WEST MCFADDEN AVENUE <br />On April 13, 2009, the Planning Commission confirmed the Zoning Administrator's action <br />approving Conditional Use Permit No. 2009-06 as conditioned; and confirmed the Zoning <br />Administrator's authorization to issue a letter of Public Convenience and Necessity for the <br />approval of a Type 20 Alcohol Beverage Control license in order to sell beer and wine for <br />off-premise consumption at the Wal-Mart Store at 3600 West McFadden Avenue. <br />Please note the vote on the motion to approve Conditional Use Permit No. 2009-06 was as <br />follows: <br />AYES: Leo, Mill, Turner, Yrarrazaval (4) <br />OPPOSED: None (0) <br />ABSENT: Alderete, Betancourt, Gartner (3) <br />ABSTAII~TED: None (0) <br />Should the City Council decide to reconsider this action, they may set the item for public <br />hearing within 21 days of the Planning Commission's decision. <br />~ ; <br />Jay M.
