Conditional Use Permit No. 2009-08 <br />April 13, 2009 <br />Page 1 of 2 <br />Findings of Fact <br />A. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community? <br />The proposed use will provide an additional service to the <br />community by providing a high-quality business hotel that will <br />offer a variety of amenities including 3,000 square feet of <br />conference room/meeting space, media area, lounge, cafe, pool <br />and spa to it guests. Conditions of approval have been <br />included to ensure the quality and the attractiveness of the <br />overall design which will contribute to the general well being <br />of the community. <br />B. Will the proposed use under the circumstances of the particular case <br />be detrimental to the health, safety, or general welfare of persons <br />residing or working in the vicinity? <br />The proposed hotel use in conjunction with the rest of the <br />MacArthur Place South development will not be detrimental to <br />persons residing and working in the area. Any effect relating <br />to the health, safety and general welfare of persons residing <br />or working in the vicinity have been addressed through various <br />mitigation measures identified in the Addendum to Environmental <br />Impact Report 2004-02. These mitigation measures cover all <br />aspects of the hotel from construction to daily operation and <br />include mitigation measures relating to construction noise and <br />soil retention to the permitted hours of operation for material <br />deliveries and pick-ups. <br />C. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties surrounding <br />the area? <br />The proposed hotel use will not adversely affect the economic <br />stability within the MacArthur Place South development area. <br />The 185-room hotel and 3,000 square foot conference/meeting <br />rooms will provide a diverse customer base for adjacent retail <br />and restaurant uses which will reinforce the economic viability <br />of the project area. <br />A'bIENDMENT TO ZOA09-4, <br />D.~Q,S~ V A09_2 <br />
