I "Y [E ) 1' I XPIRES Jim l 20 - O: FRCS( ,�'_ ) Athena Martinez THIRD AMENDMENT TO CONSULTANT AGREEMENT N- 2007 - 015-03 THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is made and entered into this 3rd day of June, 2009, between Rehabilitation Institute of Southern California, a California non - profit public benefit corporation (hereinafter "Consultant") and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City "). RECITALS: A. City and Consultant entered into Agreement N- 2007 -015 dated January 1, 2007, Amendment N- 2007 - 015 -01 dated April 26, 2007 and Amendment N- 2007 - 015 -02 dated May 31, 2008 hereinafter referred to as "said Agreement" by which Consultant provides Swimming Instruction classes. B. In accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one -year period and amend the Scope of Services to reflect increased fees for certain of the classes. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Third Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1. SCOPE OF SERVICES, shall be amended by replacing Exhibit A, attached to said Agreement, with Exhibit A -2, attached hereto. 2. Paragraph 3, TERM of said Agreement shall be amended to extend the Term to June 30, 2010. 2. Except as hereinabove amended the terms and conditions of the said Agreement shall remain in full force and effect.
