INSURANCE ON FILE N-2005-088-04 <br />'JiORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />JERK OF COUNCIL <br />FOURTH AMENDMENT TO AGREEMENT <br />O: PRCS( ) <br />Athena Martinez THIS FOURTH AMENDMENT TO AGREEMENT is entered into on the P day of <br />June, 2009, by and between ALICIA DROZD, and individual dba Healthy U ("Consultant") and <br />the City of Santa Ana, a charter city and municipal corporation of the State of California <br />("City"). <br />RECITALS: <br />A. The parties entered into Agreement 9N-2005-088, dated June 24, 2005, Amendment N-2005- <br />088-01 dated May 15, 2006, Amendment N-2005-088-02 dated April 19, 2007 and <br />Amendment N-2005-088-03 dated March 26, 2008 (hereinafter "said Agreement") by which <br />Consultant has provided instruction in operating a babysitting business as part of the City's <br />Leisure Class program. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to renew <br />said Agreement for an additional one year period and amend the Scope of Services to reflect <br />reduced fees for the class. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Fourth Amendment <br />Agreement, the parties agree as follows: <br />1. Section 1. SCOPE OF SERVICES, shall be amended by replacing Exhibit A, attached to <br />said Agreement, with Exhibit A-2, attached hereto. <br />2. Section 3, TERM, shall be amended to extend the termination date to June 30, 2010. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to <br />Agreement on the date and year first written above. <br />ATTEST: <br />CITY OF SANTA ANA <br />o <br />Patricia E.
