1. Executive Summary <br />Supplement to an EIR <br />Supplement to an EIR is authorized by State CEQA Guidelines and cEQA statues (Section 1 6163, Public <br />Resources Code Section 21166) as follows- <br />(a) The Dead or Responsible Agency may choose to prepare a supplement to an EIR rather than a <br />subsequent EIR if: <br />1 Any of the conditions described in Section 16162 would require the preparation of a <br />subsequent EIR (see below), and <br />(2) QnIy minor additions or changes would be necessary to make the previous EIR adequately <br />apply to the project in the changed situation. <br />(b ) The supplement to the EIR need contain only the information necessary to make the previous EIR <br />adequate for the project as revised. <br />(c ) A supplement to are EIR shall be given the same kind of notice and public review as is given to a <br />draft EIR under Section 15087. <br />d supplement to an EIR may be circulated by itself without recirculating the previous draft or final <br />EIR. <br />(e ) When the agency decides whether to approve the project, the decision -mal ing body shall consider <br />the previous EIR as revised by the s upplemental El R. A finding under Section 1 5091 shall be made <br />for each significant effect shown in the previous Ells as revised. <br />Conditions That Require Preparation of a Subsequent EIR <br />Pursuantto CEQA Guidelines and CEQA statues (Section 1 5162, Public Resources code Section 21166), a <br />Subsequent EIR must be prepared if: <br />(a ) Substantial changes are proposed in the project which will require major revisions of the <br />environmental impact report. <br />b Substantial changes occur with respect to the circumstances under which the project is being <br />undertaken which will require major revisions in the environmental impact report. <br />{c New information of substantial importance, which was not known and could not have been mown at <br />the time the environmental impact report was certified as complete, becomes available. <br />This S upplement to the El contains only the information necessary to make the certified Santa Ana Second <br />Main Track EIR adequately apply to the project in the changed situation. In this way, the S EIR is prepared to <br />augment, through supplementation, the previously certified EIR to the extent necessary to address the <br />conditions described in Section 1 5163 of the cEQA Gu idelines. The lead agency is required to consider the <br />prior EIR as revised by the supplement in its deliberations whether to approve the project. Therefore, the <br />Santa Ana Second Main Tracy Final EIR is included herein by reference. Findings are required for each <br />significant effect shown in the previous EIR. Because this document is a supplement to the previous EIR, <br />impacts and conditions presented in the previous EIR will serge as the primary base of comparison for <br />analysis.
