from further review and determined that a mitigated negative declaration <br />and mitigation monitoring plan for Environmental Review No. 2005-42 will <br />be filed for this project. Asa "responsible agency," the Agency agrees that <br />this environmental document appropriately analyzes the project and <br />complies with the California Environmental Quality Act, and that it will <br />implement or see to the implementation of any mitigation measures <br />specified as its responsibility under the mitigation monitoring plan. <br />F. Pursuant to the provisions of the California Redevelopment Law, the <br />Agency and the City Council have held a duly noticed joint public hearing on <br />the proposed sale of the Site pursuant to the Agreement. The Agency <br />Board has considered all evidence submitted, both oral and written, as has <br />been fully advised prior to adoption of this Resolution. <br />G. The 40 apartments to be built by Vista Del Rio on the Site will all <br />have recorded covenants restricting their use for 55 years to rents <br />affordable for families with extremely low and very low incomes (and low <br />income as to the 41st, manager's unit) and only for special needs tenants. <br />H. As part of the project, approximately 0.465 acres owned by the <br />Agency immediately adjacent to the project that are to be transferred to the <br />City of Santa Ana to be improved and maintained by the City for open <br />space and park purposes, shall directly benefit the residents of the project <br />by providing them with an open space amenity, and are a reasonable and <br />fundamental component of the affordable, rental housing units to be <br />constructed by Vista Del Rio. <br />Section 2. The Disposition and Development Agreement is hereby approved, <br />and the Executive Director of the Agency is hereby authorized to execute the Agreement, <br />with such non-substantive changes as may be approved as to form by Agency's General <br />Counsel. <br />Section 3. The on-site and off-site improvements required by the Disposition <br />and Development Agreement are hereby approved by the Agency and title to the 0.465 <br />acre parcel is authorized to be transferred to the City of Santa Ana, pursuant to Health & <br />Safety Code § 33334.2(e)(2), because both (i) these improvements are part of the new <br />construction of affordable housing units for extremely low and very low income persons <br />that are directly benefited by the improvements, and are a reasonable and fundamental <br />component of the housing units, and (ii) the Disposition and Development Agreement <br />approved by the Agency requires that the units remain available at affordable housing <br />cost to, and occupied by, persons and families of extremely low, very low, or low income <br />(as to the 41st, manager's unit) for fifty-five (55) years. <br />Section 4. The Executive Director of the Agency is hereby authorized to take all <br />steps, and to sign all documents and instruments necessary to implement and carry out <br />Resolution CRA No. 2009-011 <br />Page 2 of 3 <br />
