not less than forty (40) hours nor more than eighty (80) <br />hours. <br />Sec. 10-225. Trust Fund. <br />The City Council hereby creates the City of Santa Ana Anti-Graffiti <br />Trust Fund. Penalties assessed against violators of this Ordinance shall be <br />placed in the fund, along liens, assessments and judgments collected <br />pursuant to this Article, as well as any monetary donations received from <br />individuals or from the business community wishing to contribute to the <br />fund. The Council shall direct the expenditures of monies in the fund. <br />Such expenditures shall be restricted to the payment of the cost of graffiti <br />removal, the payment of rewards pursuant to Section 10-226 of this Article <br />and such other public purposes as may be approved by the Council. <br />Section 7. Sections 17-70.1 and 17.70.2 of the Santa Ana Municipal Code are <br />hereby re-designated as Sections 10-226 and 10-227, respectively, and amended to read <br />as follows: <br />Sec. ~-7-79-~ 10-226. Reward provisions. <br />(a) Pursuant to Section 53069.5 of the Government Code, the city may <br />offer a reward for information leading to <br />the apprehension and conviction of any person who places graffiti on any <br />public or private property in such amounts approved by the City Council. <br />v+eiafiee- In the event of multiple contributors of information , <br />the reward amount shall be divided by the city in the a manner it shall deemed <br />appropriate h 'ef. For the purposes of this section, diversion of the <br />offending violator to a community service program, or a plea bargain to a lesser <br />offense, shall constitute a conviction. <br />(b) Claims for rewards under this section shall be filed, r~rnnccc•cr~l ~.,,~ <br />with the City in a manner specified by <br />City Council oa+•+hliehoi-! by +ho r~nlinc thief <br />(c) The person convicted of committing the graffiti offense shall be liable <br />for any rewards paid pursuant to this section and, if that person is an <br />unemancipated minor, the custodial parent of said minor shall be liable for any <br />rewards paid pursuant to this section. In the event of damage to public or <br />private property, the offender or the parents or legal guardian of any <br />unemancipated minor must reimburse the City for any reward paid. <br />Ordinance No. NS-XXX <br />Page8of15 <br />50A-9 <br />
