RECORDING REQUESTED BY <br />AND WHEN RECORDED RETURN TO: <br />T-Mobile <br />Omnipoint Communications, Inc. <br />3 MacArthur Place, #1100 <br />Santa Ana, CA 92707 <br />Attn: Property Management <br />Site #: LA13160A <br />MEMORANDUM OF LEASE <br />THIS MORANDUM OF LAND LEASE AGREEMENT is made and entered into as <br />of -D Rc%� 1, , 2009, by and between City of Santa Ana, a charter city and <br />municipal corporation organized and existing under the Constitution and laws of the State of <br />California ("Lessor") and Omnipoint Communications Inc., a subsidiary of T-Mobile USA Inc., a <br />Delaware corporation ("Lessee"). <br />WITNESSETH: <br />That Lessor hereby leases to Lessee and Lessee hereby leases from Lessor a portion of <br />that certain real property (the "Property") in the State of California, County of Orange, City of <br />Santa Ana commonly known as 1801 W. Segerstrom Ave., Santa Ana, CA 92704, a legal <br />description of which is shown in Exhibit A attached hereto and incorporated herein by reference, <br />under the terms and,conditions of the unrecorded Land Lease Agreement by and between Lessor <br />and Lessee dated byj--essor , 2009, and incorporated herein by reference <br />(the "Agreement") for an initial term of ten (10) years, commencing on the Commencement <br />Date, as defined in the Agreement, and three (3) subsequent optional extension terms of five (5) <br />years each, pursuant to the terms of the Agreement.
