RECORDING REQUESTED BY ) <br />AND WHEN RECORDED MAIL TO: ) <br />City of Santa Ana } <br />Attn: �jX C'1 ark ) <br />20 Civic Center Plaza,M-30 ) <br />Santa Ana, CA 92702 ) <br />This document exempt from recording fee per Government Code <br />§ 27383. <br />A-2000-1 54 <br />GROUND LEASE <br />Preamble and Recitals <br />This lease is entered into on September 5, 2000 by and between the City of Santa Ana, a municipal <br />corporation and charter city duly organized and existing under the Constitution and laws of the State of <br />California, referred to in this lease as "Landlord," and the Delhi Center, a California nonprofit public benefit <br />corporation, referred to in this lease as "Tenant." <br />A. Landlord is the owner of certain real property in the County of Orange, State of California, described in <br />Attachment "A ," which is`attached hereto and incorporated herein and made a part of this lease (referred to in <br />this lease as "the .Premises"). <br />B. Tenant desires to lease the Premises for the purpose of constructing a community center ("the Community <br />Center"), appurtenant parking areas, and other related improvements (collectively referred to in this lease as <br />"the Improvements") in accordance with the agreement of the parties as set forth in this lease. <br />C. For purposes of constructing the Community Center the parties hereto will enter into an additional <br />agreement wherein the Landlord agrees to use its expertise in facilitating all aspects of constructing the <br />Community Center. <br />ARTICLE 1 <br />LEASE OF PREMISES AND TERM OF LEASE <br />Section 1.01. Agreement to Lease <br />For and in consideration of the rents to be paid and covenants to be performed by Tenant under this <br />lease, Landlord agrees to lease the Premises to Tenant, and Tenant agrees to lease the Premises from landlord, <br />on the terms and conditions set forth in this lease. Except as expressly otherwise provided in this lease, "the <br />Premises" includes the real property plus any appurtenances and easements described in Attachment "A " of <br />this lease, exclusive of any Improvements now or subsequently located on the Premises, notwithstanding that <br />any Improvements may or shall be construed as affixed to and as constituting part of the described Premises, <br />and without regard to whether ownership of the Improvements is in Landlord or in Tenant. <br />Section 1.02.
