V, <br />AMENDMENT TO AGREEMENT TO <br />N-2007-086-001 <br />o% (2) PWA PROVIDE BATTERY RECYCLING <br />C.i1Y1l*y nInG71t� <br />'THIS AMENDMENT, made and entered into this I' day of September, 2009, by and between Curbside <br />Inc., ("Consultant") and the City of Santa Ana, a charter city and municipal corporation duly organized and <br />existing under the Constitution and laws of the State of California ("City"), collectively referred to herein <br />as "the Parties". <br />RECITALS <br />A. The Parties entered into that certain agreement entitled "Agreement to Provide Small Battery <br />Recycling, N-2007-086, dated July 1, 2007, hereinafter referred to as "said Agreement"; and <br />B. The Parties hereto now desire to extend the term of said Agreement. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the <br />parties hereto do hereby agree as follows: <br />1. Section 3, "TERM", shall be deleted in its entirety and replaced with the following: <br />"This Agreement shall commence on July 1, 2007 and terminate on expenditure of allocated <br />funds, unless terminated earlier in accordance with Section 12, below." <br />2. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and <br />in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the date <br />and year first above written. <br />ATTEST: <br />MARIA D.
