REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />NOVEMBER 2, 2009 <br />TITLE: <br />APPEAL NO. 2009 -05 FOR TENTATIVE <br />PARCEL MAP NO. 2009 -01 TO SUBDIVIDE A <br />RESIDENTIAL PROPERTY INTO TWO <br />SEPARATE PARCELS AT 1013 SOUTH <br />ELLIOTT PLACE - PETER PRAM, APPLICANT <br />c <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1" Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Set Appeal No. 2009 -05 (Tentative Parcel Map No. 2009 -01) as a public <br />hearing item on the next regularly scheduled City Council meeting. <br />PLANNING COMMISSION ACTION <br />On October 12, 2009, the Planning Commission denied Appeal No. 2009 -02 <br />and adopted a resolution denying Tentative Parcel Map No. 2009 -01 by a <br />vote of 5:0 (Yrarrazaval absent) to subdivide a residential property into <br />two separate parcels at 1013 South Elliott Place located in the Single <br />Family Residential (Rl) zoning district. The Planning Commission upheld <br />the recommendation of the Zoning Administrator and agreed that the <br />subdivision request conflicted with several policies within the City's <br />General Plan Urban Design and Land Use Elements and would not be a <br />benefit to the community in the long term. <br />The applicant has elected to appeal the decision of the Planning <br />Commission to the City Council per Section 34- 132(a) of the Santa Ana <br />Municipal Code (SAMC). Further, Section 34- 132(b) of the SAMC requires <br />that the notice of an appeal be placed on the agenda of the next <br />regularly scheduled City Council meeting, at which time the City Council <br />shall declare that a public hearing on the matter will be held at is next <br />subsequent regularly scheduled meeting. <br />ZONING ADMINISTRATOR ACTION <br />On September 9, 2009, the Zoning Administrator adopted a resolution <br />denying Tentative Parcel Map No. 2009 -01. <br />12A -1 <br />
