FOR THE USE OF <br />HOMELESSNESS PREVENTION AND RAPID REHOUSING <br />GRANT FUNDS (Program Year 2009-10) <br />THIS AGREEMENT, is hereby made and effective this 30t" day of <br />September 2009, by and between the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("CITY") and Mercy House <br />Transitional Living Centers, Inc., a California nonprofit organization <br />("SUBRECIPIENT"). <br />a <br />WITNESSETH <br />RECITALS: <br />•� N <br />This AGREEMENT is made with reference to the following facts, among others: <br />1. The CITY has applied for and anticipates receiving funds from the United States <br />Department of Housing and Urban Development ("HUD") from the Homelessness <br />Prevention Fund, hereafter referred to as the Homelessness Prevention and Rapid Re - <br />Housing Program ("HPRP")," under Title XII of the American Recovery and Reinvestment <br />Act of 2009 ("Recovery Act"), to provide financial assistance and services to either <br />prevent individuals and families from becoming homeless or help those who are <br />experiencing homelessness to be quickly re -housed and stabilized. <br />2. SUBRECIPIENT has submitted to CITY an application for funding of a housing <br />and community development activity. <br />3. CITY adopted its FY 2008-09 Annual Action Plan, (hereinafter referred to as <br />"ANNUAL ACTION PLAN"), including any substantial amendments, which sets forth the <br />PROJECT described herein. <br />4. HUD will annually review the performance of CITY to determine whether CITY <br />has carried out its Homelessness Prevention and Rapid Re -Housing Program ("HPRP") <br />assisted activities in a timely manner and has significantly disbursed HPRP funds. <br />5. HUD has accepted and certified the aforementioned ANNUAL ACTION PLAN. <br />6. CITY approved an allocation of $398,910 in PROJECT funding to <br />SUBRECIPIENT for the Fiscal Years 2009-2012. <br />Page 1 of 28 <br />
