b. All rights of subrogation are hereby waived against CITY, its <br />officials, officers, agents and employees when acting within the scope of their <br />employment or appointment. (Endorsement must be attached to Certificate of Insurance). <br />C. With respect to the operations of the named insured, <br />operations performed on behalf of CITY, CITY shall be added as an additional insured <br />on all insurance policies required by this AGREEMENT except for Workers' <br />Compensation/Employers' Liability. (Endorsement must be attached to Certificate of <br />Insurance). <br />d. SUBRECIPIENT is aware of the provisions of Section 3700 of <br />the California Labor Code which requires every employer to be insured against liability for <br />Worker's Compensation or be self-insured in accordance with the provisions of that code. <br />The SUBRECIPIENT will comply with such provisions and shall furnish the CITY <br />satisfactory evidence of such compliance for the period of this AGREEMENT, statutory <br />Worker's Compensation Insurance and Employer's Liability Insurance with minimum limits <br />of $1,000,000 per occurrences. <br />e. It is agreed that any insurance maintained by CITY will apply <br />in excess of, and not contribute with, insurance provided by these policies. (Endorsement <br />must be attached to Certificate of Insurance for the General Liability policy and Sexual <br />Misconduct Liability policy). <br />f. Commercial General Liability policy shall contain a severability <br />of interests clause. <br />8. CITY expressly retains the right to require SUBRECIPIENT to <br />increase or decrease insurance of any of the above insurance types throughout the term <br />of this AGREEMENT. Any increase or decrease in insurance will be deemed by CITY <br />Attorney as appropriate to adequately protect the CITY. In addition, the City Attorney <br />retains the right to require additional insurance coverage as may be deemed appropriate <br />to adequately protect CITY. CITY's requirements shall be reasonable and shall be <br />designed to assure protection from and against the kind and extent of risks which exist at <br />Page 12 of 28 <br />
