DO NOT RECORD <br />purposes to which it presently is and may, at the option of Landlord, be <br />devoted. Tenant undertakes and agrees to use the Lease Area and to <br />exercise this Lease at all times in such manner as will not unreasonably <br />interfere with the full use and enjoyment of the Property by Landlord. <br />(c) Tenant hereby acknowledges that title to the Property is vested in <br />Landlord and agrees never to assail or resist the same, and further agrees <br />that Tenant's use and occupancy of Lease Area shall be referable solely to <br />the permission herein given. <br />(d) As a covenant to this Agreement, Tenant shall adhere to and comply with <br />all responsibilities enumerated in the Rider, attached hereto and <br />incorporated herein as Exhibit C. Failure to comply with the terms <br />contained within the Rider shall be good cause for termination of this <br />Agreement. <br />Section 1.02 Term <br />(a) The term of the Agreement for renting the Property ( "Term ") shall <br />commence on October 1, 2009 ( "Commencement Date ") and shall <br />continue on as a month -to month tenancy. <br />(b) Notice of intent to vacate or termination of the landlord- tenant relationship <br />is only valid with thirty (30) days prior written notice to the other party. <br />Section 1.03 Rent. <br />(a) Upon the Commencement Date, Tenant shall pay to Landlord monthly compensation <br />in the amount of $7,327.00 per month ( "Rent ") for use of the Lease Area. Rent will be <br />due upon execution of this Agreement and thereafter on or before the 5th of each month, <br />payable to "The City of Santa Ana" and remitted to: The City of Santa Ana at City Hall <br />(6th Floor), 20 Civic Center Plaza (M -25) Santa Ana, CA 92701. A late charge of ten <br />percent (10 %) shall be applied after any payment hereunder is not received by the 5th day <br />of each month. If City Hall is closed on the 5th, payment will be due on the next business <br />day. <br />(b) Tenant's monthly rental payments shall be subject to a CPI adjustment annually <br />on the anniversary of the Commencement Date during the term hereof. <br />Section 1.04 Non - Possessory Interest <br />Landlord retains full possession of the Lease Area and Tenant will not acquire any <br />interest temporary, permanent, irrevocable, possessory or otherwise by reason of this <br />Agreement, or by the exercise of the permission given herein. Tenant will make no claim <br />to any such interest. Any violation of this provision will immediately void and terminate <br />this Agreement. <br />
