NOV 2 3 Z~~1~ N-2005-079-001 <br />o ; ~i~v~/ ~~~,~~-Cz~ <br />Tcm ~-~ <br />AMENDMENT No. 1 <br />TO THE WATER CONSERVATION FUNDING AGREEMENT NO. 66657 <br />BETWEEN <br />THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA <br />AND <br />City of Santa Ana <br />There is now in effect an Agreement between The Metropolitan Water District of <br />Southern California (Metropolitan) and the City of Santa Ana (Santa Ana) entered into as of <br />1/1/2005, hereinafter referred to as Agreement. <br />WHEREAS, under this Agreement Metropolitan assists member agencies in <br />implementing a variety of water conservation measures, which includes providing funding to <br />retrofit devices with more efficient models. <br />WHEREAS, Metropolitan's Board approved the Region-wide Commercial /Industrial / <br />Institutional Conservation (CII) Program in January 2004, in which Santa Ana can participate <br />pursuant to this First Amendment. <br />THEREFORE, the parties desire to amend the Agreement with this First Amendment as <br />follows. Pursuant to Section S: Incentive Amount and Payment there will be added the following <br />paragraph: <br />5.5 Metropolitan funding for specified incentives administered through the CII program <br />shall be in the form of a conservation credit on Metropolitan's water service invoice <br />to Member Agency. In recognition of receiving these incentives, Member Agency <br />pledges to increase efforts to achieve landscape and commercial conservation, and <br />support these programs through local cost share. Metropolitan's financial obligation <br />for funding will be for the time period specified and/or until funds are exhausted on <br />that item or a determination by Metropolitan's Board not to provide a specified <br />incentive. <br />First Amendment 1 Santa Ana, Agreement No. 66657 <br />
