<br />Agreement #W7.GJC-10 <br />City of Santa Ana <br /> <br />1 (a) General Assurance. Every reasonable course of action will be taken by CONTRACTOR in order <br /> <br />2 to maintain the integrity of this expenditure of public funds and to avoid favoritism and questionable or <br />3 improper conduct. This Agreement will be administered in an impartial manner, free from efforts to gain <br /> <br />4 personal, financial or political gain. CONTRACTOR, its officers and employees, in administering this <br /> <br />5 Agreement, will avoid situations which give rise to a suggestion that any decision was influenced by <br /> <br />6 prejudice, bias, special interest or desire for personal gain. <br /> <br />7 (b) Emplovment of Former State or COUNTY Emolovees. CONTRACTOR will ensure that any of its <br /> <br />8 employees who were formerly employed by the State of California or the County of Orange, in a position <br /> <br />9 that could have enabled such individuals to impact policy regarding or implementation of programs covered <br /> <br />10 by this Agreement, will not be assigned to any part or phase of the activities conducted pursuant to this <br /> <br />11 Agreement for a period of not less than two (2) years following the termination of such employment. <br /> <br />12 (c) Conductina Business Involvina Relatives. No relative by blood, adoption or marriage of any <br /> <br />13 executive or employee of CONTRACTOR will receive favorable treatment when considered for enrollment <br /> <br />14 in programs provided by, or employment with, CONTRACTOR. <br /> <br />15 (d) Conductina Business Involvina Close Personal Friends and Associates. Executives and <br /> <br />16 employees of CONTRACTOR will be particularly aware of the varying degrees of influence that can be <br /> <br />17 exerted by personal friends and associates and, in administering this Agreement, will exercise due <br /> <br />18 diligence to avoid situations which give rise to an assertion that favorable treatment is being granted to <br /> <br />19 friends and associates. <br /> <br />20 (e) Avoidance of Conflict of Economic Interest. No executive or employee of CONTRACTOR, <br /> <br />21 elected official in the area, or voting or non-voting member of a WIB, will solicit or accept money or any <br /> <br />22 other consideration from a third person, for the performance of an act reimbursed in whole or part by <br /> <br />23 CONTRACTOR or COUNTY. Supplies, materials, equipment or services purchased with Agreement funds <br /> <br />24 will be used solely for purposes allowed under this Agreement. No voting member of the OCWIB will cast <br /> <br />25 a vote on the provision of services by that member (or any organization which that member represents) or <br /> <br />26 <br /> <br />W1A Cost Reimbursement Agreement - Green Jobs Corps <br /> <br />36 <br />
