INSUhANCE ON FILE <br />WORK MAY PROCEED <br />UNTILI~RAN;EEXPI~R~S ` G <br />CLERKOFCOUNCIL ~ <br />~.r~. 12 - l 1 <br />~~ THIRD AMENDMENT TO AGREEMENT <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on November <br />~ 23, 2009, by and between Clinical Laboratory of San Bernardino, a Califomia <br />corporation ("Consultant') and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br />,~~ RECITALS: <br />f n 0, A. The parties entered into that certain Consultant Agreement #A-2003-239, dated <br />~ V December 31, 2003, (hereinafter "said Agreement") by which Consultant has <br />- ~ provided domestic water quality testing. <br />/ B. Said Agreement has twice been amended to extend the term and add compensation to <br />pay for services during the extended term. <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term for an additional six-month period. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Third Amendment to Agreement, the parties agree as follows: <br />1. Consultant shall continue to provide domestic water quality testing as set forth in <br />Exhibit A to said Agreement, at the rates and charges set forth in Exhibit B to said <br />Agreement. <br />2. Section 3, TERM, shall be amended tc> extend the term for an additional six-month <br />period, through June 30, 2010. <br />3.
