<br />INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />OATF' 12-l(-CC{ <br />'\2-, <br /> <br />A-2009-I89 <br /> <br />FIRST AMENDMENT TO <br />COOPERATIVE AGREEMENT <br /> <br />i) <br />.~ <br />-Bars <br />-;:1 I <br />-Q'<3= <br />~ <br />N -- <br />~ <br />.- :::i <br />c <br />'CJ'::! <br /> <br />THIS FIRST AMENDMENT TO COOPERATIVE AGREEMENT is made and entered <br />into this I5t day of December, 2009, by and between the City of Santa Ana, a charter city <br />and municipal corporation of the State of California, ("City") and the County of Orange <br />("County"). <br /> <br />RECITALS: <br /> <br />~ <br /> <br />A. The City on behalf of all jurisdictions in Orange County, has been designated to <br />receive grant funding provided by the U.S. Department of Housing and Urban <br />Development (HUD) pursuant to the Housing Opportunities for Persons With <br />AIDS (HOPW A) program; and <br /> <br />B. City has entered into a HOPW A grant agreement with HUD; and <br /> <br />C. The City has contracted with the County since 1993 to provide supportive housing <br />services for persons living with HIV/AIDS. During the City's last HOPW A <br />funding cycle the City changed the contract year to coincide with the City's fiscal <br />year and changed the agreement term to one year, with the stipulation that any <br />unused funds be returned to the City for reallocation. <br /> <br />D. The City and County agree to amend the Cooperative Agreement with the County <br />dated July 1,2009 ("said Agreement") to include additional funds. Said <br />Agreement stated that '"the budget may be modified by mutual written agreement <br />of the Contract Officers". <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />contained in the Agreement, and subject to all the terms and conditions of the Agreement, <br />City and the Project Sponsors agree as follows: <br /> <br />L The Cooperative Agreement dated July 1,2009, shall be amended to include in <br />the grant amount an additional Two Hundred Sixty Two Thousand Dollars <br />($262,000) with $18,340 of said amount set aside for Administration Costs, so <br />that the total maximum obligation set forth in subsection A. of section II. Budget <br />shall be One Million Two Hundred Thirty Seven Thousand Forty Three Dollars <br />($1,237,043). <br /> <br />2. Except as hereinabove modified, the original terms and conditions of the <br />Agreement remain in full force and effect. <br />
