REQUEST FOR <br /> ~ ~ a~ ~ <br /> COUNCIL ACTION ~ <br /> CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: <br /> JANUARY 4, 2010 <br /> TITLE: APPROVED <br /> As Recommended <br /> COOPERATIVE WORK AGREEMENT As Amended <br /> Ordinance on 1St Reading <br /> EXTENSION WITH THE Ordinance on 2"d Reading <br /> DEPARTMENT OF TRANSPORTATION Implementing Resolution <br /> FOR FLOWER STREET BIKE TRAIL Set Public Hearing For <br /> AND BRISTOL WIDENING PROJECTS <br /> / CONTINUED TO <br /> ~ ~ ~ Wit..,- FILE NUMBER <br /> CITY MANAGER <br /> RECOMMENDED ACTION <br /> Direct the City Attorney to prepare and authorize the City Manager and the <br /> Clerk of the Council to execute a Cooperative Work Agreement Extension with <br /> the Department of Transportation to extend the completion deadline and <br /> scope of work on Flower Street Bike Trail and Bristol Street Widening <br /> projects. <br /> DISCUSSION <br /> The Flower Street Bike Trail is being constructed with Department of <br /> Transportation Bicycle Transportation Account Grant (BTA) funds. The grant <br /> requires that the City complete the project and submit final invoicing to <br /> the State by April 2010. The project is currently under construction and is <br /> scheduled to be completed by mid-February 2010. <br /> Because the completion date of the project is close to the April 2010 <br /> deadline, the Department of Transportation is requesting the city submit a <br /> Cooperative Work Agreement (CWA) Extension as insurance, in the event the <br /> project is delayed due to unforeseen circumstances. The agreement will also <br /> identify a Scope of Work change to reduce the improvement area due to <br /> funding limitations. The City has applied for competitive grant funding to <br /> complete the bike trail connection. <br /> The Bristol Street Widening Project is funded through a number of grant <br /> funds including a $971,000 Federal fund from National Corridor Planning and <br /> Development Program (NCDP). The grant requires the funds to be expended by <br /> June 30, 2010 or an extension must be filed by the City. The City used some <br /> of the NCPD funding to pay for right-of-way acquisition for the segment <br /> between Pine & Third Streets. The remainder of the funds will be used for <br /> the intersection of Seventeenth and Bristol Streets. The Department of <br /> Transportation is requesting that the City execute a Cooperative Work <br /> <br /> Agreement Extension to ensure all funding is protected in the event the <br /> <br /> project goes beyond the deadline of June 30, 2010. <br /> 25E-1 <br /> <br />
