LST1.20.10 <br />°- <br />RESOLUTION NO. 2010-003 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AUTHORIZING THE EXPANSION OF THE <br />ENTERPRISE ZONE <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The City Council hereby finds, determines and declares as follows: <br />A. On September 2, 2009, the City of Santa Ana ("City") received a Final <br />Designation from the California Department of Housing and Community Development <br />(HCD) for a new fifteen (15) year Enterprise Zone, which became effective June 8, 2008. <br />B. The Enterprise Zone program was established by the State of California <br />legislature for the purpose of stimulating the economy in areas deemed by the State to be <br />economically challenged. The Program offers State Tax Incentives to businesses in the <br />Zone which, in turn, help the City retain and attract companies within the Zone. <br />C. The Program regulations allow for Enterprise Zones to expand their Zone by <br />up to fifteen percent (15%) of the originally approved area. The 15% expansion areas do <br />not have to meet the strict requirements of the original Enterprise Zone areas. Through <br />the expansion process, more businesses will become eligible to reduce their costs by <br />taking advantage of the various Enterprise Zone State Tax Incentives. <br />D. The City Council of the City of Santa Ana wishes to expand the <br />boundaries of its Enterprise Zone to include the geographic area set forth in the <br />attached boundary map. <br />E. Land included with the proposed expansion area is zoned for industrial or <br />commercial use and the City has jurisdiction over the proposed expansion area. <br />Section 2. The City Council of the City of Santa Ana does hereby support and <br />approve the Santa Ana Enterprise Zone expansion into the areas of the City of Santa <br />Ana as shown on the attached map and hereby approves and authorizes the submittal <br />of the expansion application to be filed with HCD. <br />Section 3. The City Council deems the Deputy City Manager for Development <br />Services as the Contact Person on behalf of the City. The City Council hereby directs <br />and authorizes the Deputy City Manager for Development Services or their designee, <br />on behalf of the City, to sign the application and execute all documents, Memoranda of <br />Understanding, and instruments necessary or appropriate for implementation of the <br />expansion of the Enterprise Zone. <br />Section 4.
