<br /> Ordinance Second Reading <br /> Ordinance Amendment No. 2009-02 <br /> February 16, 2010 <br /> Page 2 <br /> for the private party listing of a property on the Santa Ana Register of <br /> Historical Properties will not result in the removal of any currently <br /> listed properties from the Register, thereby creating no impact to <br /> historic resources. In addition, the City of Santa Ana will not be <br /> precluded from placing new properties on the Register as a result of the <br /> establishment of this fee, thereby ensuring that there are no future <br /> impacts to potential historic resources. Therefore, the establishment of <br /> this fee meets the "General Rule" exemption pursuant to Section <br /> 15061 (b) (3) . <br /> The establishment of this fee is also statutorily exempt from further <br /> review pursuant to Section 15273(a)(1), which states that, "CEQA does not <br /> apply to the establishment, modification, structuring restructuring, or <br /> approval of rates, tolls, fares, and other charges by public agencies <br /> which the public agency finds are for the purpose of: (1) Meeting <br /> operating expenses, including employee wage rates and fringe benefits." <br /> The methodology used to establish the fee for private party applications <br /> to designate a building on the Santa Ana Register of Historical Properties <br /> was based entirely on the direct and indirect costs to perform the work <br /> necessary to prepare the documents needed for the listing. This cost is <br /> entirely comprised of City operating expenses and staff time. This <br /> methodology is in compliance with State regulations requiring that fees <br /> not be in excess of the cost to provide service.
