This agreement serves as a specimen for all agreements referenced in the action to be prepared and executed once approved. <br /> Contract No. <br /> AGREEMENT UNDER THE WORKFORCE INVESTMENT ACT <br /> (AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009) <br /> THIS AGREEMENT, made and entered into this by and between <br /> <br /> the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the <br /> Constitution and laws of the State of California ("CITY") and <br /> ("CONTRACTOR"). <br /> W-I-T-N-E-S-S-E-T-H <br /> Recitals: <br /> A. CITY has been designated a Local Workforce Investment Area (LWIA) under <br /> the Workforce Investment Act of 1998, Public Law 105-220 ("the Act"). <br /> B. The State of California has created the LWIA to administer the Act programs <br /> operated by the State of California pursuant to the Act. <br /> C. As a LWIA, CITY is entitled to receive federal funds to establish programs to <br /> increase training opportunities for unemployed individuals and also to preserve and create jobs. One <br /> goal of California's Workforce Investment System is to provide the opportunities to achieve career <br /> goals that will allow individuals to successfully compete in the labor market and prepare them for <br /> higher education. <br /> D. The American Recovery and Reinvestment Act of 2009 (the "Recovery Act") <br /> includes provisions for WIA Adult and Dislocated Worker funds, WIA Youth funds including summer <br /> youth employment activities, and Wagner-Peyser Act funds for reemployment services. <br /> E. CONTRACTOR has experience in offering education, occupational <br /> development, business training, lay-off aversion and employment programs for the labor market <br /> participants in the City of Santa Ana ("said program"). <br /> F. CONTRACTOR is willing to operate said program pursuant to the Act and <br /> California law. <br /> WHEREFORE, for and in consideration of the respective and mutual covenants and <br /> promises hereinafter contained and made, and subject to all the terms and conditions hereof, the parties <br /> hereto do hereby agree as follows: <br /> I. <br /> CONTRACTOR'S OBLIGATIONS <br /> A. CONTRACTOR agrees to provide the following services pursuant to said <br /> program, as more specifically set forth in CONTRACTOR'S program narrative contained in "Exhibit <br /> 25B-3 Page 1 of 15 <br /> <br />
